 Post subject: Magistrate Hearing

I have a hearing scheduled with the Dist. Magistrate against a tenant for failure to pay rent. I've given the tenant proper notification, but to no avail.

I'm planning to take with me:
- copies of signed Lease
- copies of all correspondence concerning this issue

Is there anything else that I should provide at the hearing?

I usually take a copy of rent receipts and a rent history report. The Magistrate may also ask if there was a Security Deposit and, if so, how much. So, you may want to take a receipt for that also. Unless the tenant has a rebuttal - such as no heat, leaking water, general landlord neglect, etc., - it should be an easy decision in your favor. In most cases, the tenant won't show.

Jim,

Make sure you take a copy of your notice to quit you gave to the tenant or posted on the property and the date you gave the notice. Hopefully your lease has the clause waiving the tenants right to a notice to quit. If your lease does not have this clause let me know and I can give it to you. Good luck at the hearing!
