 Post subject: Eviction appeal

We have a tenant who has not paid rent so we filed for eviction and were given a Notice of Judgment. The tenant filed an appeal, we filed a complaint in Common Pleas Court and now have a hearing date. In the meantime, the tenant has to pay current rent to the Dept of Court Records to uphold the appeal and stay in the property.

I have some questions if anyone has been in this situation:

Will we receive the rent paid to the Dept of Court Records at some point? And will we receive the full amount or will they take out court fees, etc?

If the tenant does not pay the current rent, can we then get a court judgment so that law enforcement can get involved to physically remove the tenant if necessary?

We made a claim for damages as well as unpaid rent, which the tenant will most likely disagree with. How does the court determine what is reasonable amount for damages? For example, two estimates of work needed?

How is a Common Pleas Court hearing different than the first hearing we had with the magistrate?

Do you think it's necessary to hire an attorney for this hearing? This tenant can most likely get an attorney at no cost.
